Privacy Notice — Job Candidates & Registrants

At Class we are committed to protecting your privacy. This notice explains how we handle your personal data when you register with us, apply for a role, sign up for job alerts or otherwise use our recruitment services. It applies when we act as a controller of your personal data — that is, where we decide how and why it is processed.
The personal data we collect
Depending on how you use our service, we may collect:
- your contact details (name, email address, telephone number) and the area you are looking for work in;
- your availability, the type and hours of work you are seeking, and your work preferences;
- your qualifications, training, work history and references, and your CV;
- information needed to confirm your right to work in the UK and your identity;
- special-category and related information required for roles working with children — including health information you provide in a health declaration, and criminal-records information (including DBS disclosures and childcare-disqualification declarations); and
- if you subscribe to job alerts, your name and email address.
How we obtain your personal data
We normally collect your personal data directly from you when you register with Class, apply for a role, provide information during our recruitment and compliance checks, contact us or subscribe to job alerts.
We may also receive personal data about you from other sources where this is necessary for recruitment, compliance or safeguarding purposes. This may include:
- referees and previous employers;
- qualification, training or professional registration providers;
- the Disclosure and Barring Service (DBS);
- organisations involved in right-to-work or identity verification;
- government or regulatory bodies where permitted or required by law; and
- other organisations or individuals where you have asked us to obtain information or where this is necessary for the recruitment process.
The information we receive from these sources may include employment history, references, qualifications, identity and right-to-work information, and information relevant to safeguarding and suitability for work.
Where we obtain your personal data from another source, we will provide you with the privacy information required by applicable data protection law.
How we use your data, and our lawful basis
We use your personal data to register you with Class, assess your suitability for available roles and provide our recruitment services. We rely on our legitimate interests in operating our recruitment business and matching candidates with suitable opportunities.
Where you ask us to take specific steps in relation to a particular role, such as putting you forward for that role, we may also rely on processing being necessary to take steps at your request before entering into a contract.
We check your right to work in the UK and your identity where necessary to comply with our legal obligations.
Where you subscribe to job alerts, we send them on the basis of your consent, which you can withdraw at any time using the unsubscribe link in any alert.
Where we rely on legitimate interests as our lawful basis, we carry out a balancing test to make sure our interests do not override your rights and freedoms. You can ask us for more information about this assessment by contacting info@classrecruit.com.
Health and other special-category data
Some roles we recruit for involve working directly with children and may require us to process health information or other special-category personal data where this is necessary for recruitment, safeguarding or other lawful employment-related purposes.
Where we process special-category data, we will rely on an applicable condition under the UK GDPR and, where required, the Data Protection Act 2018, in addition to our Article 6 lawful basis. The specific conditions relied upon are documented in our internal data protection records and relevant compliance policies.
Criminal-records and safeguarding information
For roles involving work with children, we may process criminal-record information, including information obtained through DBS checks, where this is necessary to assess suitability and meet applicable safeguarding requirements.
Criminal-record information is subject to specific requirements under Article 10 of the UK GDPR and the Data Protection Act 2018. We will only process such information where we have an applicable lawful basis under Article 6 and a valid condition under the relevant provisions of UK law.
Where required, Class maintains an Appropriate Policy Document setting out the relevant processing conditions, safeguards and retention arrangements.
Where applicable to the role and level of check required, candidates may be required to provide information about relevant convictions, cautions or other criminal-record information. The information candidates are required to provide will depend on the role and applicable legal requirements, including the Rehabilitation of Offenders Act 1974, relevant Exceptions Orders and applicable filtering rules.
Class does not make decisions about a candidate's suitability for work solely through automated decision-making or profiling. Candidate suitability is assessed and signed off by an appropriately authorised member of the Class team in accordance with our Candidate Compliance Policy.
Who we share your data with
We do not sell your personal data, and we do not share it with third parties for their own marketing or other independent purposes.
Where necessary, we share personal data with trusted service providers who process it on our behalf and under our instructions, and with prospective employers as part of providing our recruitment service. We only share the personal data that is relevant and necessary for the particular purpose.
For candidates, prospective employers may include nurseries, schools and other early-years providers with whom we work. When we put you forward for a role, we share the personal data that is relevant and necessary for the prospective employer to assess your suitability for that role.
We may also share information where we are required or permitted to do so by law, including where this is necessary for safeguarding purposes or to comply with a legal obligation.
We use trusted service providers to run our website and communications, which may include our email provider, website host and security services such as Google reCAPTCHA. They process personal data on our behalf and in accordance with our instructions.
International transfers
We do not routinely transfer candidate personal data outside the UK.
Where a service provider processes personal data outside the UK, we will ensure that appropriate safeguards are in place in accordance with applicable data protection law and will provide further information where required.
How long we keep your data
We keep your registration and candidate information for as long as you remain active with Class and for an appropriate period afterwards.
The length of time we retain your information depends on the type of information, the purpose for which it was collected, our ongoing relationship with you, and any legal, regulatory, safeguarding or contractual requirements that apply.
Some information relating to recruitment and compliance checks may need to be retained for a different period from general candidate information where this is necessary to meet legal, regulatory or safeguarding requirements.
We regularly review the personal data we hold and delete or securely dispose of information when it is no longer required.
Our internal data retention and compliance procedures set out the applicable retention periods and criteria for different categories of candidate information.
If you subscribe to job alerts, we keep your job-alert subscription information until you unsubscribe or we otherwise no longer need it for that purpose.
Your rights
You have the following rights in relation to the personal data we hold about you:
- to be provided with a copy of the personal data we hold about you;
- to ask us to correct any personal data that is inaccurate or incomplete;
- to ask us to erase your personal data, or to restrict how we use it, in certain circumstances;
- to object to our processing of your personal data on grounds relating to your particular situation;
- to object at any time to our processing of your personal data for direct marketing;
- where our processing is based on your consent, to withdraw that consent at any time; and
- where applicable, to receive the personal data you gave us in a portable format.
